领事认证的概念: LEGALIZATION BY EMBASSY OR CONSULATE领事认证,又称“使领馆认证”。
领事认证的历史沿革:领事认证制度是随着国际商业往来的发展而逐步建立起来的,具有悠久的历史,在对外交往和文书流通方面具有的作用。50年代初,阿拉伯country联盟决定对以色列进行经济制裁,并抵制与以色列有经贸业务往来的外国企业。为此,阿拉伯country对向其出口的货物所涉及的单据,要求有阿拉伯country驻该国的使(领)馆予以领事认证,主要是证明出口商品与以色列无关。从此,领事认证业务得以在我国开展。随着我国对外贸易的发展,一些南美country和部分欧洲country对我国向其出口贸易也相继实施了领事认证制度。目前,世界上还有个别country还未与我国建立大使级外交关系,民间的商业往来仍很频繁。随着中国对外交往的不断扩大和中国国际地位的提升,一些country还单方面免除了中国境内文件送往该国使用的领事认证,这些country有美国、日本、法国、加拿大、澳大利亚等。在国际贸易中,对出口商的商业单据和文件以及其他机构的涉外文件由外交部、领事机构加以认证这已成为一种比较普遍的做法。领事认证不仅仅是一种国际惯例,在不少country中是以法律的形式来加以规定的。更为重要的是领事职能的一个体现,它不仅涉及到贸易问题,还涉及到国与国之间的关系。

Historical evolution of consular certification: The consularcertification system has been gradually established with thedevelopment of international business transactions, has a longhistory, and has an irreplaceable role in diplomatic exchanges anddocument circulation. In the early 1950s, the Arab country alliancedecided to impose economic sanctions on Israel, and at the sametime boycott foreign companies that have economic and tradebusiness with Israel. To this end, the Arab country requiresconsular certification from the Arab country ’s embassy (consulate)for the documents related to the goods exported to it, mainly toprove that the exported goods have nothing to do with Israel. Sincethen, the consular certification business has been able to developin China. With the development of China's foreign trade, some SouthAmerican countries and some European countries have alsoimplemented consular certification systems for China's exporttrade. At present, there are still a few countries in the worldthat have not established ambassadorial diplomatic relations withour country, but private commercial transactions are stillfrequent. With the continuous expansion of China's diplomaticcontacts and the improvement of China's international status, somecountries have unilaterally exempted the consular certification ofdocuments sent to the country from China. These countries includethe United States, Japan, France, Canada, and Australia. Ininternational trade, it has become a relatively common practice forthe exporters ’business documents and documents and foreign-relateddocuments of other institutions to be certified by the Ministry ofForeign Affairs and consular institutions. At the same time,consular certification is not only an international practice, butalso regulated in many countries in the form of laws. Moreimportantly, it is an embodiment of the consular function, whichinvolves not only trade issues, but also relations betweencountries.
